I would like to become a tax resident in Thailand as I live here for 9 months but did not work in Thailand so I don’t have a work permit. I have businesses in Canada and Australia which all incomes are from outside of Thailand. Please help me to understand about the tax policies applicable for my case and compliance to the Thai government.
Panwa: If you would like to become a tax resident in Thailand, you need to apply for Tax ID Number and file personal income tax return to the Revenue Department. Anyway, since you do not work here in Thailand, work permit is not needed; you only receive some income generated outside of Thailand.
Moreover, according to the Revenue Department’s new tax policy announcement, no. P.161 and P.162, it states that an individual has a responsibility (obligation) to file tax return for personal income tax from oversea income source under the following conditions:
- A person who has assessable income from an overseas source dated January 1, 2024 onwards in the tax year in Thailand for 180 days or above, and
- That person brought assessable income to Thailand in that tax year or in subsequent tax years.
Means that your income generated before January 1, 2024. If brought to Thailand after that date, there is no tax obligation. On the other hand your income generated in year 2024 or after and brought to Thailand in fully or partially amount in any year, these income have tax obligations.
